Photo Submission License and Warranties
By uploading any photograph(s) (the “Image(s)”) to goWhiteMountains.com and clicking “Submit,” you (the “Uploader”) hereby grant to goWhiteMountains.com, its affiliated sister sites, and Peak Dynamics LLC (the owner of the goWhiteMountains.com project), together with their successors, assigns, and any authorized sublicensees (collectively, the “Licensees”), a non-exclusive, royalty-free, perpetual, irrevocable, fully paid-up, worldwide license to:
- Use, reproduce, distribute, display, perform, modify, adapt, and create derivative works from the Image(s);
- In any and all media, formats, or channels, whether now known or hereafter developed (including websites, social media, print, digital advertising, and promotional materials);
- For any purpose, including commercial, promotional, or editorial use related to the Licensees’ sites, projects, or business activities.
This license allows the Licensees to sublicense these rights to third parties as needed.
You retain ownership of your Image(s), but the license granted is irrevocable and survives any termination of your account or use of the site.
Your Representations and Warranties
By uploading and submitting the Image(s), you represent and warrant that:
- You are the sole creator and owner of the Image(s), or you have all necessary rights, permissions, and authority to grant the license above;
- The Image(s) do not infringe or violate any copyright, trademark, privacy, publicity, or other intellectual property or personal rights of any third party;
- You have obtained all required model releases, property releases, or other consents from any identifiable individuals or property owners appearing in the Image(s); and
- The use of the Image(s) as permitted under this license will not violate any law or regulation.
You agree to indemnify and hold the Licensees harmless from any claims arising from breach of these representations and warranties.
We reserve the right to remove any Image(s) at our discretion and without notice.
